Welcome to PinLyft. These Terms of Service (“Terms”) govern your use of the PinLyft platform at https://pinlyft.space (“Service”), operated by PinLyft (“we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using PinLyft, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. You must be at least 13 years old to use PinLyft.

2. Description of Service

PinLyft is a Pinterest automation and content management platform that provides:

• Website scanning and content extraction for pin creation
• AI-powered pin content generation (titles, descriptions, images)
• Pin scheduling and automated publishing to Pinterest
• Pinterest analytics and performance tracking
• Board management and organization tools

3. Account Registration

• You must sign in using your Pinterest account via OAuth.
• You are responsible for maintaining the security of your account.
• You are responsible for all activities that occur under your account.
• You must provide accurate and up-to-date information.
• You must notify us immediately of any unauthorized access to your account.

4. Pinterest API & Compliance

PinLyft integrates with the Pinterest API. By using our Service, you also agree to:

• Pinterest Community Guidelines
• Pinterest Advertising Guidelines (if applicable)

You acknowledge that PinLyft is a third-party application and is not endorsed by, affiliated with, or sponsored by Pinterest. Pinterest may revoke API access at any time, which could affect the availability of certain features.

5. Acceptable Use

You agree not to:

• Violate any Pinterest policies or community guidelines
• Post spam, misleading, or deceptive content
• Use the Service to harass, abuse, or harm others
• Scrape, copy, or redistribute content without proper rights
• Use the Service for any illegal or unauthorized purpose
• Attempt to circumvent rate limits, security measures, or access controls
• Share your account credentials with others
• Use automated bots or scripts to access the Service outside of its intended use

We reserve the right to suspend or terminate accounts that violate these terms.

6. Content Ownership & Licenses

6.1 Your Content

You retain all ownership rights to the content you create, upload, or generate through PinLyft (including pin images, titles, descriptions, and website content). By using the Service, you grant PinLyft a limited, non-exclusive license to process, display, and transmit your content as necessary to provide the Service.

6.2 AI-Generated Content

Content generated by our AI features (including pin titles, descriptions, and images) is provided for your use. You are responsible for reviewing and ensuring that AI-generated content is accurate, appropriate, and compliant with applicable laws and Pinterest policies before publishing.

6.3 Our Content

The PinLyft platform, including its design, code, branding, and documentation, is the property of PinLyft and is protected by intellectual property laws.

7. Subscription & Billing

• Free Tier: PinLyft offers a free Starter plan with limited features and AI credits.
• Paid Plans: Paid subscriptions (Growth, Agency) provide access to additional features, higher limits, and priority support.
• Billing: Paid subscriptions are billed monthly or annually as selected at checkout.
• Cancellation: You may cancel your subscription at any time. Access to paid features continues until the end of your current billing period.
• Refunds: Subscription fees are non-refundable, except where required by law.
• AI Credits: AI credits are consumed when using AI-powered features. Unused credits do not roll over between billing periods.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including Pinterest API changes or outages).

9. Limitation of Liability

To the maximum extent permitted by law:

• PinLyft is provided “as is” and “as available” without warranties of any kind.
• We do not guarantee that pins will be published successfully, that analytics data will be complete, or that AI-generated content will be error-free.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold PinLyft harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Account Termination

• You may delete your account at any time through your account settings or by contacting support.
• We may suspend or terminate your account for violation of these Terms, with or without notice.
• Upon termination, your right to use the Service ends immediately. Your data will be deleted within 30 days in accordance with our Privacy Policy.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the “Last Updated” date and, where appropriate, notifying you via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of India.
